1. Acceptance of Terms

By accessing or using Claivy ("the Service"), available at claivyai.com, you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Service.

2. Description of Service

Claivy is a software-as-a-service (SaaS) platform that uses artificial intelligence to adapt, optimize, and tailor resumes and curricula vitae to specific job descriptions. The Service is intended to assist job seekers and does not guarantee employment outcomes.

3. Eligibility

You must be at least 18 years old to use the Service. By using Claivy, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

4. Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@claivyai.com upon becoming aware of any unauthorized use of your account.

5. Subscriptions & Payments

Claivy offers free and paid subscription plans. Paid plans are billed on a monthly recurring basis. By subscribing, you authorize us (and our payment processors, including Bold and Paddle) to charge your payment method on a recurring basis until you cancel.

• All prices are displayed in the applicable currency at checkout (COP for Colombia; USD for international users).
• Subscriptions automatically renew at the end of each billing period.
• You may cancel at any time via your account Settings page. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

6. Refund Policy

You have the right to cancel your subscription and request a full refund within 14 days of your initial purchase or any subsequent renewal, no questions asked. To exercise this right, please contact us at support@claivyai.com or contact Paddle's checkout support directly. After the 14-day period, fees are generally non-refundable, and cancellation will take effect at the end of the current billing cycle.

7. User Content

You retain full ownership of all resumes, CV data, and personal information you upload to the Service ("User Content"). By uploading content, you grant Claivy a limited, non-exclusive license to process and transform your content solely for the purpose of providing the Service to you. We do not sell, share, or use your content for any other purpose.

8. Acceptable Use

You agree not to:

• Use the Service to generate false, misleading, or fraudulent resumes or representations.
• Reverse engineer, copy, or resell any part of the Service.
• Attempt to gain unauthorized access to any account or system.
• Use automated tools to scrape, crawl, or abuse the Service beyond your subscription limits.

9. Intellectual Property

The Claivy name, logo, design, and all software underlying the Service are the exclusive property of Claivy and its licensors. Nothing in these Terms grants you a right to use our trademarks or intellectual property other than as strictly necessary to use the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein. We do not sell personal data to third parties.

11. AI-Generated Content Disclaimer

Claivy uses large language models to generate adapted resume content. The output is AI-generated and may contain inaccuracies. You are solely responsible for reviewing, verifying, and approving any content before submitting it to potential employers. Claivy is not liable for any consequences arising from the use of AI-generated content.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Claivy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or employment opportunities, arising from your use of the Service. Our total liability to you for direct damages shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7, 9, 11, and 12 survive termination.

14. Changes to Terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Colombia, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of Bogotá, Colombia.
